There are many types of injuries defined in the law with certain punishments fixed for the
guilty person. Personal injury is a type of injury that is incurred upon the body of the claimant. It includes
physical, emotional or psychological trauma to a person as opposed to damage to one's property or belongings. In
personal injury lawsuits, the victim files a lawsuit in the court against the offender who has harmed him such that
it caused him physical distress, frustration or emotional trauma.
Usually, such cases are filed in the event of road traffic accidents, claims of assault or
product liability issues concerning injuries caused due to defective products. It might also include conditions
known as industrial diseases such as mesothelemia, chronic obstructive pulmonary disease, contact dermatitis and
many other medical conditions that are a result of one's occupation. If the offender is proved to be negligent, he
may have to pay a certain amount as compensation.
The laws governing personal injury claims are quite complex. Many critics call for improvement
in these laws. Moreover, it is a tricky job to determine the cost of one's suffering. There is no compensation for
one's health, physical and emotional well-being. Until now charges for personal injury are subdivided into two
categories. These include pecuniary and non-pecuniary losses. The latter refers to physical trauma or emotional
stress while the former is used for the loss of medical expenses or any such things.
The amounts to be paid as personal injury claims, is decided by the judge of the court. The
judge also gives his ruling about the guilty party. The amount is decided keeping in mind the potential loss or
harm incurred on the claimant and the possible outcomes of the injury inflicted upon the claimant. These personal
injury claims vary greatly depending on the parties involves, the area of jurisdiction of the crime and the
regional laws where the offense was committed.
There are certain time limits fixed by every country within which a claimant must file the
lawsuit to get his payout. In the United States, this time limit is three years from the day on which the crime was
committed. However, this time limit can vary based on the type of injury incurred and the circumstances of the
event. In case, the victim is under the age of 18 at the time of offense, he can register the claim till the age of
21.
Even the owners of pets can be liable to such claims in the event that their pet has been
responsible of offending or injuring a neighbor. Therefore, one must be careful while causing harm to any other
person, not only because it is immoral, but also because it can get them into serious trouble. Personal injury
claims are applicable to virtually anybody. The amounts of payouts can be very high costing up to billions of
dollars of revenue in totality to many firms and companies. A positive aspect of such laws is that if one has
suffered from an injury due to somebody's negligence, his or her pain or discomfort can at least be somewhat
compensated.
